TERMS AND CONDITIONS

of return and exchange of goods for buyers of goods

on the website darkbyrior.com

1. GENERAL PROVISIONS

1.1. Return of goods — is a procedure during which the buyer returns the goods and, depending on the grounds for the return, receives:

  • 1.1.1. exchange of goods (partial or full); and/or

  • 1.1.2. refund of funds (partial or full).

1.2. The return of goods is mandatory and unconditional within 14 (fourteen) calendar days from the moment of actual receipt (delivery to the consumer) of the Goods in a warranty case, and can also be carried out based on the seller's decision in a non-warranty case, considered individually for each case.

  • 1.2.1. Payment for the delivery of the Goods to the Seller, as well as after the consideration of the claim from the Seller to the Buyer within the territory of the Republic of Poland in warranty and non-warranty cases, is carried out at the expense of the Seller. If the goods for the claim and after its consideration are sent from outside the borders of the Republic of Poland, the delivery of the Goods is paid for by the Buyer (at the same time, in the case of satisfying the Buyer's claim, the Seller compensates the Buyer for the delivery costs).

  • 1.2.2. The estimated value of the Goods is determined in the amount of the real value of the Goods indicated on the Website.

  • 1.2.3. For the convenience of the buyer, the return of goods under this paragraph may be carried out on the basis of an application, the template of which is Annex No. 2 to this document.

  • 1.2.4. The Seller returns the funds on the basis of a properly drawn up application within 5 (five) working days from the moment the Seller receives the goods. If the buyer has not provided other details for the refund, the funds are returned to the account from which the payment for the Goods was made.

1.3. Regardless of the provisions of this document, the Buyer (consumer) has the right to an unconditional return of the Goods within 14 (fourteen) calendar days from the moment of actual receipt of the Goods by the buyer or a third party indicated by the buyer other than the carrier.

  • 1.3.1. An exception to this rule are cases where the Buyer (consumer) has opened a sealed cosmetic Good (broken the sealing — in the case of gel-polish products or the factory packaging — in the case of milling cutters, polishers, files), as such Good becomes unsuitable for return due to health protection and hygiene reasons. At the same time, the Buyer has the right to return cosmetic goods even on condition of breaking the seal or factory packaging in the case of improper quality of the goods (warranty cases). The Buyer (consumer) also has the right to refuse the Goods until the moment of its receipt.

  • 1.3.2. In case the Buyer (consumer) exercises this paragraph, the Buyer (consumer) bears the costs of returning (delivery) the Goods to the Seller.

1.4. The manufacturer guarantees the quality of the goods until the expiration of its shelf life, subject to the conditions of transportation, use, and storage.

  • 1.4.1. In case of opening gel-polish products, the quality guarantee is valid for 18 months from the moment of opening, but until the expiration of the shelf life, provided the proper transportation, use, and storage of this type of goods.

  • 1.4.2. The Seller recommends that the Buyer perform a cursory inspection at the post office of the parcel(s) with the goods for signs of its (their) damage, excessive moisture, or other damage caused during transportation. The provisions of this paragraph do not limit the rights of the Buyer guaranteed by national legislation and Directive 2011/83/EU of the European Parliament and of the Council of 25.10.2011 on consumer rights.

  • 1.4.3. The Seller also recommends that the Buyer perform a cursory inspection of the goods at the post office for damage caused during transportation. In the case of a large number of units in the order (more than 10 units) for obvious factory defects of the packaging, which falls under the definition of a warranty case, the buyer should check the goods within 5 (five) working days from the moment of receipt of the goods. The provisions of this paragraph do not limit the rights of the Buyer guaranteed by national legislation and Directive 2011/83/EU of the European Parliament and of the Council of 25.10.2011 on consumer rights.

1.5. The general policy regarding the return and exchange of goods is aimed at satisfying the client's need for receiving high-quality goods and service, even in the case of an error by the client himself, taking into account the requirements of Directive 2011/83/EU of the European Parliament and of the Council of 25.10.2011 on consumer rights.

1.6. The decision to recognize a case as a warranty or non-warranty case is made without undue delay within 14 calendar days from the moment the client submits a properly drawn up claim. If during the client's first contact the claim was not properly drawn up, the date of the start of the period for consideration of the claim is counted from the moment of proper drawing up of the claim.

2. WARRANTY CASES

2.1. Warranty cases are considered to be those in which the defect or dissatisfaction with the goods is related to a factory defect or an error on the part of the manufacturer, namely:

  • 2.1.1. Damaged product packaging, i.e.: a chip or crack in the bottle, broken packaging, absence or defect of the brush, leakage of goods, damage to the cap or thread, except for cases of packaging damage during transportation.

  • 2.1.2. Violation of the physical and external properties of the product, in particular: delamination of the product that does not disappear after thorough mixing; the presence of sediment in the form of a film, lumps, or foreign inclusions that do not disappear after thorough mixing; excessive thickening or, conversely, watery consistency; defects in color and pigmentation (change in color compared to the available goods; significant loss of color saturation after polymerization); coating defects (chips, cracks, or peeling immediately or shortly after application in accordance with the correct technology; uneven application, streaks, "bald spots"); odor defects (sharp, unusual, or chemically changed smell that does not correspond to the norm for this product).

  • 2.1.3. Foreign objects or impurities inside the packaging (debris, fibers, hard particles that are not part of the product formula).

  • 2.1.4. Goods do not polymerize / do not dry subject to the manufacturer's recommendations regarding:

  • type of lamp,

  • power, polymerization time,

  • material compatibility,

  • any other confirmed factory defect revealed during the use of the product.

  • 2.1.5. Error in completion on the part of the seller (wrong goods, volume, shade, or quantity sent).

  • 2.1.6. Goods are expired or incorrectly labeled, i.e.:

  • absence of the expiration date or batch number;

  • labeling text is partially illegible.

  • 2.1.7. The shelf life expired at the time of shipment of the goods.

  • 2.1.8. Inconsistency of the goods with the declared characteristics, if this is confirmed by the manufacturer's control (e.g., inconsistency of texture or functionality not related to storage or use conditions, and inconsistency of the actual and declared shade/color).

2.2. Procedure for client's actions in case of detecting a warranty case:

  • 2.2.1. Client's actions. In case of a warranty case, the client is obliged to contact the seller with a written claim in any convenient form that allows the seller to record the application. For the convenience of the buyer, he can use the application form which is Annex No. 1 to this document.

  • 2.2.2. Requirements for the claim. The claim must mandatory include the buyer's first and last name, order number, description of the defect, as well as an attached photo/video of the goods, proof of purchase of the goods from the Seller, and documents confirming the receipt of the goods. To check the goods with the manufacturer, the buyer must provide a photo of the barcode of the goods.

  • 2.2.3. Special actions in the warranty case provided for in clause 2.1.1. If the damage to the packaging or goods was detected at the post office upon receipt of the goods, the client is obliged to notify the seller and document this fact together with the employees of the post office. The client should send a copy of the drawn-up report, photos, and videos of the damaged goods to the seller.

2.3. The provisions of clause 2.2. of this document do not limit the Buyer in the form of contacting the Seller. The consumer has the right to submit a claim in any way that allows the Seller to record the Buyer's demands.

2.4. The Seller, as a result of considering the client's claim, takes one of the following decisions:

  • 2.4.1. exchange of goods (full or partial), used as a priority way of considering the claim, if the Buyer has not made another request;

  • 2.4.2. refund of funds along with the return of the corresponding part of the goods to the seller;

  • 2.4.3. re-shipment of the goods to the client in the appropriate part;

  • 2.4.4. refusal to satisfy the claim with appropriate justification.

2.5. In case of satisfying the claim by refunding funds, the Seller returns the funds on the basis of the application submitted by the buyer within 5 (five) working days from the moment the Seller receives the goods.

3. NON-WARRANTY CASES

3.1. Non-warranty cases are considered to be those in which the defect or dissatisfaction with the goods is not related to a factory defect or an error on the part of the manufacturer/seller. A case may be recognized as non-warranty if, as a result of the client's application and the provided materials or after conducting internal control, the absence of the declared defect, failure, or inconsistency with the product's characteristics is established, namely:

  • 3.1.1. Sending the wrong goods not through the fault of the seller, including errors when placing an order by the client (wrong shade, volume, product, etc. selected).

  • 3.1.2. Goods do not polymerize / do not dry if during the check it was found that the product is of high quality and meets the declared requirements, and the problem arose due to:

  • an unsuitable or weak lamp,

  • non-compliance with the recommended polymerization time,

  • incompatibility of materials,

  • violation of application technology.

  • 3.1.3. Taking into account the specifics of the Goods sold, namely cosmetic goods — unjustified, i.e., not falling under the definition of a warranty case, exchange or return of used goods, as well as goods with broken packaging (opened, partially used product) is not carried out and is not a warranty case. Exchange/return of goods is allowed in the case when an error occurred on the part of the seller during the placement or completion of the order (wrong goods, volume, shade, or quantity sent); such a case is considered a warranty case regardless of the fact of opening or use of the goods.

  • 3.1.4. Defects caused by the client, in particular:

  • improper storage (high/low temperature/humidity, exposure to sunlight),

  • violation of transportation conditions after receipt of the goods,

  • use after the expiration date.

  • 3.1.5. Individual allergic reaction or hypersensitivity, as this is a characteristic of the body and not a defect of the goods.

  • 3.1.6. Inconsistency with the subjective expectations of the client, including cases where the color shade differs from the image in the photo (due to individual screen settings, lighting, type of base, or application specifics).

  • 3.1.7. Damage to the goods during transportation.

3.2. The provisions of clauses 2.2. – 2.3., 2.5. of this document apply to non-warranty cases.

3.3. The manufacturer/seller does not consider claims for exchange or return of goods, refund of funds, and also does not make any compensations to the client in case of recognizing the case resulting from the submitted claim as non-warranty.
