WEBSITE TERMS OF SERVICE AGREEMENT

І. GENERAL PROVISIONS

1.1. Description of Services

The website darkbyrior.com is an online store with an assortment of cosmetic products, in particular, for manicures and pedicures, skin care, etc.

1.2. Definitions and Interpretations

Only the Site Administration, in addition to the court, has the right to interpret this agreement. For the purposes of this Agreement, terms are defined as follows:

1.2.1. Agreement: This document (Website Terms of Use Agreement).
1.2.2. The Site: The web page hosted at darkbyrior.com, including all subdomains and subfolders.
1.2.3. The User: A natural person with full civil legal capacity who has agreed to these terms.
1.2.4. Site Administration: "DARK BY RIOR" SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (NIP: 5273103291, KRS: 0001093048, REGON: 52805532800000; Warsaw, Poland) and its authorized representatives.
1.2.5. Personal account: The User's specific account on the Site created via the registration form.
1.2.6. Personal data: Information relating to an identified or identifiable natural person as defined in Article 4 of the GDPR.
1.2.7. Goods: Material cosmetic products or related items available on the Site.

1.3. Public Offer

This Agreement is a public offer. Interaction with the Site constitutes conclusion of this Agreement. Users without full civil legal capacity must immediately stop using the Site.

1.4. Unconditional Acceptance

Any interaction (registration, ordering, following links) signifies unconditional agreement with all clauses. Ignorance of these terms does not exempt the User from responsibility.

1.5. Disagreement

If the User does not agree with any terms, they must stop using the Site and leave it immediately. The User bears all risks associated with continued use despite disagreement.

ІІ. USER ACCOUNT

2.1. Registration: The Site reserves the right to refuse or delete accounts in case of violations of Polish/EU law or these terms.
2.2. User Warranties: By creating an account, the User guarantees they will:
- Order Goods legally and use them as intended.
- Not use criminal funds for purchases.
- Provide accurate and up-to-date Personal Data.
- Not disrupt Site operations or perform illegal actions.
- Protect the account from unauthorized access.
- Not transfer account access to third parties.
- Create only one account per person.
2.3. Prohibitions: Users may not share access. Unauthorized access may lead to temporary or permanent blocking.
2.4. Liability: The legal owner of the account is responsible for all actions taken through it.
2.5. Account Deletion: Users may delete their accounts only if all obligations to the Site Administration are fulfilled.

ІІІ. INTELLECTUAL PROPERTY RIGHTS

3.1. Ownership: All materials on the Site belong to the Site Administration and are protected by Polish and international intellectual property laws. Unauthorized use is illegal.
3.2. Quoting: References to the Site are mandatory when quoting its materials.
3.3. Feedback: Feedback provided on public resources may be used by the Site Administration without compensation, including for promotional purposes in social networks and messengers.
3.4. Reliability: The Site Administration does not guarantee the accuracy of third-party feedback sourced from other online resources.

ІV. RESPONSIBILITY

4.1. Legal Compliance: Users must not violate Polish, EU, or international law. The Administration may demand compensation for damages caused by such violations.
4.2. Disputes: Disputes shall be resolved via negotiation. If failed, they will be resolved in the courts of the Republic of Poland.
4.3. Product Info: Information on the Site represents possible terms of sale but is not a fixed offer until confirmed.
4.4. Content Aging: The Administration is not obliged to update old materials and is not liable for damages arising from the use or inability to use the Site.
4.5. Pre-payment Changes: Liability for changing product info before payment is limited to the User's right to refuse the service.
4.6. Payment Security: Responsibility for transfers lies with banks and payment systems.

Note: Payments are processed via STRIPE on secure pages using PCI DSS standards and SSL protocols. The Site Administration does not receive or store your card details.
4.7. Data Accuracy: Users are liable for all losses incurred by the Site Administration due to incorrect contact/registration data.
4.8. Technical Availability: The Administration is not responsible for equipment functionality, data transmission channels, or external links.
4.9. Newsletters: The Administration may send advertising messages to registered addresses. Users may opt out at any time.
4.10. "AS IS": All materials are provided without express or implied warranties.
4.11. Advertising: Materials may be accompanied by ads. The Administration may offer discounts and promotions without separate User permission.
4.12. Third-party Rights: Users must not use their account to violate the rights of third parties.

V. FINAL PROVISIONS

5.1. Validity: The Agreement is valid until all obligations are fulfilled. Termination of the Agreement means the User can no longer use the Site.
5.2. Consent: Acceptance signifies consent to data processing (GDPR) and agreement with the Privacy Policy, Disclaimer, and Cookie Policy.
5.3. Communication: Users consent to electronic notifications via email or messengers (WhatsApp, Telegram, etc.).
5.4. Amendments: The Administration may change the Agreement without notice. Continued use implies consent to new versions.
5.5. Denial of Service: The Administration may deny Site use to any User at any time.
5.6. Inactivity: Accounts inactive for more than 12 consecutive months may be cancelled unilaterally.
5.7. Governing Law: Governed by the laws of the Republic of Poland and the European Union.
5.8. Severability: Invalidity of one provision does not affect the validity of the others.
5.9. Language: Written in Ukrainian, English, and Polish. In case of discrepancies, the Polish text has priority.
