PRIVACY POLICY

I. TERMINOLOGY

1.1. For a more accurate understanding of the terms of this privacy policy, the following terms are used in it:

  • 1.1.1. Privacy Policy – This document (Privacy Policy).

  • 1.1.2. Website – a web page hosted at darkbyrior.com, including all subdomains (subfolders), owned by the Website Administration.

  • 1.1.3. Website Administration – "DARK BY RIOR" SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (country: POLAND, voivodeship: MAZOWIECKIE, WARSAW, ul. GOLESZOWSKA, No. 3, premises ---, code 01-249, NIP: 5273103291, KRS: 0001093048, REGON: 52805532800000) – a legal entity registered in accordance with the current legislation of the Republic of Poland and/or persons authorized by it to manage the Website.

  • 1.1.4. User – a natural person who has full civil legal and legal capacity and who uses the Website.

  • 1.1.5. GDPR – Regulation (EU) 2016/679 regarding the protection of natural persons with regard to the processing of personal data.

  • 1.1.6. Personal data – any information relating to an identified or identifiable natural person (the User), as defined in Article 4 of the GDPR.

1.2. Exclusively the Administration of the Website, in addition to the court, has the right to interpret the Privacy Policy, as well as the terms used in it.

ІІ. GENERAL PROVISIONS

2.1. The Administration and its authorized representatives respect the privacy of Users and undertake to protect it using the methods described in this Policy.

2.2. This Policy specifies which Personal Data is collected and how it is processed. It applies to data collected through the Website in both offline and online modes.

2.3. The User is obliged to carefully familiarize himself with each clause. In case of disagreement, the User must immediately stop using the Website.

ІІІ. COLLECTION OF PERSONAL DATA

3.1. By using the Website, the User may provide the following information:

  • 3.1.1. Data provided via forms (e.g., "Comment to the order"), including:

    • 3.1.1.1. Surname, first name, and patronymic (if available);

    • 3.1.1.2. Location (country, city);

    • 3.1.1.3. Address of residence/stay;

    • 3.1.1.4. Phone number;

    • 3.1.1.5. E-mail address;

    • 3.1.1.6. IP address.

  • 3.1.2. Information about orders, basket content, and purchases.

  • 3.1.3. Search queries on the Website.

  • 3.1.4. Other data provided by the User.

3.2. Data provided outside the Website (e.g., via Instagram, Telegram, WhatsApp) is transmitted at the User's own risk according to those platforms' policies.

3.3. If providing data of third parties, it is assumed the User has obtained prior consent. The User bears all responsibility for such actions.

3.4. The User consents to the recording of conversations for service quality improvement.

3.5. The Website is not intended for persons under 18. If data from a child under 13 is collected without parental consent, it will be deleted. Contact the DPO at admin@darkbyrior.com to report such cases.

IV. PERSONAL DATA PROCESSING

4.1. Data is collected for providing services, selling goods, service improvement, marketing, and statistics.

4.2. The Administration acts as the administrator/controller of the data.

4.3. Processing Purposes (based on Art. 6 GDPR):

  • 4.3.1. Fulfillment of contract (point "b"): organizing delivery and order fulfillment.

  • 4.3.2. Analytics and statistics (point "f"): analyzing User actions to improve functionality.

  • 4.3.3. Legal defense (point "f"): claim-related work and protecting rights.

  • 4.3.4. Marketing (point "f"): publishing and sending marketing content.

4.4. Social media data (TikTok, Instagram, etc.) is processed based on legitimate interest in promoting the brand.

4.5. Activity is registered in internal databases for security and administrative management.

4.6. Data is processed until consent is withdrawn. Requests sent to admin@darkbyrior.com will be handled within 5 working days.

4.7. Processing may be extended as required by law for the defense of legal claims.

V. TRANSFER OF PERSONAL DATA

5.1. Data may be disclosed to IT providers, analytical tools, and logistics organizations.

5.2. Periodic transfers include:

  • 5.2.1. Quickley Inc.: name and email for the Website chat.

  • 5.2.2. DPD BeLux and Geopost: name and email for Goods transportation.

  • 5.2.3. Twilio Inc. (USA): phone number for SMS order status notifications.

5.3. Payments are processed via "STRIPE" (Stripe Payments Europe, Limited). The Administration does not transfer data to this entity directly, but the User provides data on Stripe’s site under Stripe's own privacy policy.

5.4. Users may request info about specific data recipients from the DPO at admin@darkbyrior.com.

5.5. Data may be disclosed to competent authorities if required by current legislation.

VI. TRANSFER OF PERSONAL DATA OUTSIDE THE EEA

6.1. Data is transferred outside the EEA only when necessary, ensuring protection through SCCs (Standard Contractual Clauses) or European Commission adequacy decisions.

6.2. Currently, data is transferred outside the EEA only to Twilio Inc. (USA) as described in clause 5.2.3.

VIІ. USER RIGHTS

7.1. The User has the right to access, correct, delete, or restrict processing, as well as the right to data portability, the right to object, and the right to file a complaint with a supervisory authority.

7.2. Consent can be revoked at any time via admin@darkbyrior.com.

7.3. This Policy does not narrow the scope of the User's legal rights.

VIII. SECURITY OF PERSONAL DATA

8.1. Ongoing risk analysis ensures only authorized persons have access to data necessary for their tasks.

8.2. Contractors are required to use appropriate security measures when processing data on behalf of the Administration.

IX. FINAL PROVISIONS

9.2. The designated Data Protection Officer (DPO) can be reached at admin@darkbyrior.com.

9.3. The policy is updated as necessary. New editions are effective from the moment of publication.

9.4. Users who disagree must stop using the Website and notify the Administration.

9.5. Current version effective from October 1, 2024.

9.6. This Policy is written in Ukrainian, English, and Polish. In case of discrepancies, the Polish text has priority.
